Privacy policy

Last updated: October 2026

1. Introduction and scope

This privacy policy explains how Nidino AG (hereinafter «we», «us» or «Nidino») processes personal data, that is, how we collect, use, store, disclose and protect it. It is based on the Swiss Federal Act on Data Protection (FADP) and the Data Protection Ordinance (DPO), which have been in force since 1 September 2023.

This policy applies in particular to personal data of:

  • Parents and legal guardians as well as prospective clients
  • Children cared for in Nidino home nurseries (Tagesfamilien)
  • Home nursery caregivers, other employees and job applicants
  • Visitors to our website and people who communicate with us
  • Contact persons at municipalities, partner organisations and service providers

2. Controller

The controller responsible for data processing is:

Nidino AG
Uraniastrasse 31
8001 Zurich
Switzerland
Email: info@nidino.com

You can reach us at this address for all data protection matters.

3. Personal data we process

3.1 Parents and legal guardians

  • Contact data: name, address, phone number, email address
  • Contract data: childcare contract, care days and times, assigned home nursery, terminations
  • Billing data: invoices, payments received, bank details
  • Subsidy data: municipality of residence, subsidy decisions and information that municipalities require to calculate subsidies
  • Communication data: content of enquiries, emails and messages (e.g. via WhatsApp)

3.2 Children in our care

  • Name, date of birth, care details, emergency contacts
  • Health information (e.g. allergies, medication, special needs), only to the extent necessary for safe care
  • Observations from daily care, to the extent necessary for educational support

We usually receive data about children from their parents. Parents exercise their children's rights on their behalf.

3.3 Home nursery caregivers, employees and job applicants

  • Application data: personal details, CV, references, diplomas and language certificates, reference checks
  • Suitability assessment: results of interviews and home visits, criminal record extracts (standard and special private extract), information about persons living in the household, to the extent necessary for the assessment
  • Personnel data: employment contract, workload, working hours, salary and social security data (incl. AHV number), bank details, absences, training and further education, employment references

3.4 Website and digital communication

  • Technical data such as IP address, browser type and version, time of access
  • Information you enter in forms (e.g. registrations)
  • Data from cookies and similar technologies (see section 11)

3.5 Sensitive personal data

Some of the data listed above is considered sensitive under the FADP, in particular health data of children and employees and data from criminal record extracts. We process this data only where strictly necessary for childcare, suitability assessments or the employment relationship, and we protect it with particular care.

4. Purposes of processing

  • Childcare and placement: placing children in care, concluding and managing childcare contracts, organising care
  • Selecting and supporting home nurseries: recruitment, suitability and safety checks, employment, supervision, training and quality assurance
  • Billing and subsidies: invoicing, payroll, processing subsidies with municipalities
  • Communication: answering enquiries, informing you about our services, customer service
  • Administration and efficiency: internal organisation, documentation and support through digital tools, including AI-based tools (see section 6)
  • Improving our services: analysing the use of our website
  • Legal obligations: meeting statutory reporting, supervisory and retention obligations

5. Basis for processing

We process personal data in accordance with the principles of the FADP, in particular lawfully, in good faith, proportionately and only for the stated purposes. We usually process data because it is necessary to conclude or perform a contract, because we are legally required to do so, or because we have an overriding legitimate interest, for example in safe childcare and efficient organisation. Where the law requires consent, we obtain it explicitly. You can withdraw your consent at any time with effect for the future.

6. Use of artificial intelligence (AI)

We use the AI service «Claude» provided by Anthropic PBC (USA). It supports us in drafting texts and correspondence, summarising information and preparing internal documentation. The following applies:

  • Data processing agreement: We use a business version of Claude and have a data processing agreement with Anthropic. Anthropic may process the data only on our behalf and according to our instructions.
  • No training: Under the contractual terms, Anthropic does not use the data we enter to train its AI models.
  • Data minimisation: We only enter data that is necessary for the task at hand and avoid names and other identifying details wherever possible. As a rule, we do not enter health data or data from criminal record extracts into AI tools.
  • Human oversight: AI output is reviewed by our staff. Decisions about people, such as the suitability of a home nursery or the allocation of a childcare place, are always made by humans.
  • Abroad: Processing may take place in the USA. For how the data is protected, see section 8.

7. Disclosure of personal data

We only disclose personal data if this is necessary for our services, if we are legally required to do so, or if you have consented. We do not sell personal data. Recipients may include:

  • Home nurseries: information needed to care for your child
  • Municipalities: for processing subsidies and for reports in connection with the supervision of home nurseries
  • Authorities and social insurance institutions: e.g. AHV compensation office, unemployment insurance fund, pension fund, accident insurance and tax authorities, as required by law
  • Accreditation bodies: e.g. kibesuisse, to the extent necessary for accreditation and quality assurance
  • Processors: service providers who process data on our behalf, in particular for IT and cloud services, accounting, payroll, time tracking, project management, forms, customer communication, website operation and AI services. We contractually require these providers to comply with data protection law.
  • Other third parties: banks for payment transactions as well as fiduciaries and legal advisers who are bound by professional secrecy

8. Disclosure abroad

Some of our processors process personal data outside Switzerland, in particular in EU and EEA countries and in the USA (e.g. when we use Claude). We only disclose personal data to countries whose level of data protection the Federal Council has recognised as adequate (Annex 1 DPO), for example to US companies certified under the Swiss-U.S. Data Privacy Framework. Where adequate protection is lacking, we safeguard the disclosure with standard contractual clauses recognised by the Federal Data Protection and Information Commissioner (FDPIC), including the adjustments required for Switzerland, or rely on a statutory exception. On request, we will gladly tell you which countries and safeguards are involved.

9. Retention and deletion

We keep personal data only as long as necessary for the respective purpose or as required by statutory retention obligations. We generally keep business records such as contracts and accounting documents for ten years (Art. 958f of the Swiss Code of Obligations). We delete data from application processes once the process is complete, unless you have agreed to longer retention. We delete or anonymise data that is no longer needed.

10. Data security

We take appropriate technical and organisational measures to protect personal data against loss, misuse and unauthorised access. These include in particular role-based access restrictions, secure login procedures, encryption, careful selection and contractual obligation of our service providers, and the obligation and training of our employees and home nursery caregivers to maintain confidentiality. If a data security breach nevertheless occurs that is likely to result in a high risk for the persons concerned, we report it to the FDPIC and, where necessary, inform the persons concerned.

11. Website and cookies

When you visit our website, technical data is processed to provide the website and ensure its security. We use cookies and similar technologies. Technically necessary cookies are required for the website to work. We also use analytics and marketing cookies, including from third-party providers such as Google. You can block or delete them in your browser at any time.

12. No automated individual decisions

We do not make decisions based solely on automated processing that have legal consequences for you or significantly affect you.

13. Your rights

Within the scope of applicable law, you have in particular the right to:

  • request information on whether and which personal data we process about you
  • have incorrect data corrected
  • request the deletion of your data, unless statutory retention obligations or overriding interests prevent this
  • object to processing
  • request the release or transfer of your data in a common electronic format, where provided for by law
  • withdraw any consent given at any time with effect for the future

Please send your request in writing to the address given in section 2. To protect your data, we may ask for proof of identity. We usually respond to requests within 30 days. You also have the right to lodge a complaint with the Federal Data Protection and Information Commissioner (FDPIC), Feldeggweg 1, 3003 Bern, www.edoeb.admin.ch.

14. Changes to this privacy policy

We may amend this privacy policy at any time, in particular when we introduce new services or tools or when legal requirements change. The version published on our website applies.
